ANPC verified more than 250 economic operators that sell mobility and recovery devices for people with disabilities

The National Authority for Consumer Protection (ANPC) carried out, between 09 and 13.09.2024, throughout the country, a series of actions to verify compliance with the legal provisions in the field, when selling prostheses, orthoses, wheelchairs, aerial corrective lenses and contact, hearing aids, etc., sold directly and online as part of a control theme.

They were controlled 262 de economic operators which marketed different products from the mentioned category, DEVIATIONSbeing identified at 202 of these.

The amount of verified products is over 4 million lei, and the value of those with DEVIATIONS is about 800.000 lei.

For the non-conformities found, the following sanctions were applied:

● 153 contravention fines, worth plague650.000 lei

● 144 warning

● temporary stop from marketing of approximately 11.000 products, for labeling deficiencies

● definitive stop from marketing a 6 products,for the expiry date

● remedial measure sites for sale online, for 2 economic operators.

"Protecting consumers is an absolute priority, especially when we're talking about essential health and mobility devices, especially needed by people with disabilities. Through these control actions, ANPC aims not only to sanction violations, but also to educate and correctly inform economic operators, in order to ensure consumers' access to quality products that comply with legal standards. We continue to closely monitor the market and act firmly, so that every citizen benefits from safe and correctly labeled products and services," said Sebastian Hotca, interim president of ANPC.

Among the most frequent irregularities found, we mention:

- labeling deficiencies (without the Romanian translation of the identification and characterization elements or the manuals with instructions regarding assembly, use and possible warnings, etc.)

- non-compliance with the promotions regime

- the marketing of some products without being accompanied by a guarantee certificate

- lack of complete information to benefit from the product warranty

- the warranty of conformity does not comply with legal requirements

- correct and complete information about the conditions for cancellation and granting of the guarantee

- making the granting of the guarantee conditional on the presentation of the product's original packaging

- no display of sale price

- lack of operating permits

- the lack on the commercial website of the standardized withdrawal form and the information according to which the consumer will have to bear the cost of returning the goods in case of withdrawal

- the lack of the link to the ANPC website and the SAL plate (Alternative Dispute Resolution) on the marketing website.
