According to article 5 paragraph 2 of law no. 245/2004 (r1) on general product safety, transposition of the European directive 2001/95/EC:
” If the manufacturers and distributors are aware or should be aware, based on the information they possess and as specialists, that some products, which they have placed on the market or which have been supplied in another way to consumers, present risks that are incompatible with general security requirements, they must immediately inform the competent authorities, under the conditions set out in Annex 1, specifying the actions taken in order to prevent risks for consumers."
The transmission of information to ANPC will be carried out both by correspondence on paper (with the signature of the authorized person and the company's stamp) and in electronic format according to the attached notification form (Romanian/English).
In accordance with EU legislation, economic operators must ensure that the products they place on the market are safe. Economic operators who discover that one of their products is dangerous must take measures to prevent possible accidents, even being able to recall the product, if it is already in the possession of consumers.
In this sense, in order to support economic operators when publishing a recall notice, the European Commission recommends using the following model Recall Form for dangerous products:
