Seaside hotel, sanctioned by ANPC

On 29.08.2024, the National Consumer Protection Authority (ANPC) carried out an operative control action, within the Coastal Command 2024, at Hotel Delta, in the Jupiter resort managed by the economic operator Delta Aurora SA.

For the detected deviations from the legislation in the field, ANPC commissioners applied the following sanctions:

- contravention fines in the amount of 63.000 lei
- temporarily stopping the provision of services in the food block, until the deficiencies are remedied
- definitive stoppage of the sale of non-compliant food products
- remedying information deficiencies, within a maximum of 30 days
- the proposal to issue the decision to cease misleading commercial practices regarding consumer information.

"Unfortunately, ANPC commissioners also encounter such situations during controls. Even if they have been advised, some economic operators continue to ignore the provisions of the law, which is why we are forced to take the measure of stopping the activity, aimed at preventing the endangerment of consumers" - Sebastian Hotca, interim president of ANPC.

The irregularities encountered were the following:

- the use of unsafe products, respectively: raw materials with the minimum durability date exceeded, the use of raw materials with a modified thermal state, contrary to the manufacturers' requirements, direct storage of food products and raw materials on the floor

- the provision of services that may endanger the life, safety or health of consumers through: the use of unsanitary refrigerating units, intended for bottled drinks in which raw materials and food were stored, refrigerating equipment with structural deficiencies (cheddar and shelves with traces of rust ), the use of an unsanitary space intended for the storage of vegetables and fruits used in the technological process of the food block, the use, at the bar, of raw materials containing, as an ingredient, E129 "Allura Red", without informing consumers about the health risks

- the use of deceptive commercial practices by intentionally providing erroneous information on the composition and ingredients of finished preparations intended for consumers

- improper technical conditions: structural deficiencies of the floor and walls in 2 of the accommodation rooms of the unit, verified by survey, non-compliant labeling of the amperage of the electrical appliances in the verified accommodation units,

- the lack of consumer information, in accommodation spaces, and maps of free and paid services, according to the classification of the 3* accommodation unit.
